Urgent Help: Legal notice received in the name of my Father for non repayment of Personal Loan of Assam Gramin Vikash Bank,

My father took personal loan of xyz amount IDK from Assam Gramin Vikash bank
Before completion of repayment tenure he passed away on year 2010, Bank had filed a case against my father in the district court.

Today a Notice came in the name of my Father, asking him to report District Session Court on 09-03-2024.
Current due amount 18401+ Interest as per notice.

My Question is do i/we family merbers have to repay the loan amount?
Do i need to be present at the District court on mentioned date? while the notice is in the name of my father only who is no more alive
What should i do now?

You are legal representative of your father so you can't ignore the summon. But this seems open and shut case as limitation period is of 3 years. You can't suddenly wake up and file for recovery of money.

I am thinking of writing a letter to that Bank Branch, informing them that i am his Legal son ,and he passed away on 2010 and request the bank to write off the loan.

I just called a lawyer he advised me to , present the death certificate of my Father to the district court, and tell them that we were un aware of that loan.

If you are his legal hier .
Meaning you inherited his property.
Then unsecured loan you are liable to pay .incase there was no insurance.

What you can fight is paying only sum & not penalties & interest .

You can directly talk to the bm in bank & settle it .
If u go via court route .
Follow legal advice but settle in jan - adalat of the district . which happens regularly.

If you didn't inherent his property u aren't liable.

Amount is 18k so I don't think it worth the hassle .

U can earn that in 4-5 month via cc 🙂 if u have good portfolio.

Since its a long time NPA.
Pay half to full amount due ( only sum ) not intrest+ late fees + more intrest levied .
Visit branch & get it done .u don't have to visit court

Since its a long time NPA they would be happy to settle .
NOw everything depends on your negotiation skill+ u can go with lawyer.

Will be goint to hometown next week , so then i will visit the branch and will talk to BM.

They will even settle for half of amount . No worries.
You can use the point being unaware of the loan .+ Its very old .

Pay or not thats different . Settling the case is more important.

I have seen farmer was offered to pay 10 k to 60k loan .
So yea settle & pay if u can afford .
But pay the lowest possible
