Ongoing Harassment by Bajaj Finance

Background

My brother, who is unmarried and lives alone, has been missing since 22nd March 2025. A missing person report has been filed and is currently under active police investigation.

Until 14th April 2025, we had no knowledge of any financial obligations on his part. On that day, a man claiming to be from Bajaj Finance’s NSP Branch, Delhi, appeared at my residence, demanding repayment for Loan No. P401PFD11701953, allegedly taken by my missing brother. The loan is linked to his PAN: AQZPK1*46Q.

I want to state clearly:

  • I am not a borrower, co-borrower, guarantor, or even a reference for this loan.
  • I have never signed any documents or consented to being contacted regarding this loan.
Despite this, Bajaj Finance agents continue to harass me with calls, visits, and threats.


Instances of Harassment

Here are some key incidents since 14th April:

  • 14th April 2025 – A Bajaj Finance representative came uninvited to my home and demanded EMI payments, despite being told I had no connection to the loan.
  • 18th April 2025 – I received multiple harassing calls from the following number(s):
    📞 +91 9810641749, +91 8920366079
    The callers were aggressive and abusive.
  • 26th April 2025 – A particularly threatening call came from 📞 +91 9310390593, where the recovery agent:
    • Threatened to break down doors and windows of my home
    • Said they would bring dhols (drums) to publicly shame me
    • Pressured me to share the contact numbers of relatives
These acts are not only unethical but illegal. I am being humiliated and psychologically tortured for something I have zero involvement in.


Bajaj Finance’s Disappointing Response

When I attempted to raise a written complaint, Bajaj Finance replied that my email ID is "not registered" and thus they couldn’t process my grievance. Ironically, they had no issue calling and threatening me on a phone number I never provided to them.

Hiding behind technicalities while harassing uninvolved individuals—especially vulnerable citizens—is not just dishonest, it’s deeply inhumane.


My Condition & Next Steps

I am a senior citizen, already coping with the trauma of a missing family member. This harassment has left me anxious, sleepless, and mentally distressed. My health has deteriorated due to the constant fear and pressure from these unprovoked threats.

I have filed a complaint with the RBI Ombudsman, and I am preparing legal action for:

  • Harassment
  • Emotional distress
  • Misuse of personal information
I have maintained logs of all calls, visits, and agent phone numbers. These will be submitted as evidence if required.


Final Appeal

This harassment is in relation to Loan No. P401PFD11701953—a loan I have absolutely no legal or contractual link to. I demand that Bajaj Finance immediately stop all communication and threats against me.

I urge Bajaj Finance and other NBFCs to adhere to the RBI’s recovery guidelines, especially while dealing with unrelated family members and senior citizens.

No one should be harassed for a loan they didn’t take.

Sorry to hear about what you are going through.
We hear you and understand you.
However, I would like you to understand that TechnoFino is one of the best platforms to raise financial awareness, seek financial knowledge related to banking, cards, RBI regulations, etc but this may not be the most appropriate platform to directly urge/demand/appeal/request anything from Bajaj Finance. RBI Ombudsman complaint, a police complaint, a legal notice are some of the better options to create an impact in such cases alongside posts in Twitter and communities like TechnoFino.

Given the severity of your situation, you should first file a police complaint about the digital and physical harassment and intimidation done by the representatives of Bajaj Finance and Bajaj Finance itself.
Also, with the help of a lawyer, send a court notice to Bajaj Finance based on the ground you have, with all the evidences in court admissible format.


The RBIO complaint step was also the right thing to do.

You are probably already aware of the next course of action that you should take, so please go ahead with that.

Forget about RBI guidelines for a minute, this is a normal (and it should NOT be!) modus operandi of lenders when the borrower evades the EMI, becomes unreachable, then the lender starts reaching out to folks who are staying at the addresses that were shared by the borrower with the lender.

Horrible... You've done the right thing by filing a complaint with the RBI BO against Bajaj Finance. If the RBI doesn't help you, you should definitely go ahead with legal action.

Some Big Questions Arise:
  1. How can Bajaj Finance harass someone who never took a loan, never signed any document, and is not even a guarantor?
  2. Why do NBFCs, especially giants like Bajaj Finance, blatantly ignore the RBI’s clear guidelines on recovery practices?
  3. How can Bajaj Finance employees threaten a senior citizen, visit his home, and demand repayment of someone else’s loan?
Bajaj Finance is clearly at fault here. Despite reaching out, they’ve offered no help. The member has already filed a complaint with the RBI Banking Ombudsman (BO), hoping for justice.
But the bigger question is: why should a senior citizen have to face this in the first place? Why don’t major NBFCs follow the RBI’s rules? And more importantly, why doesn’t the RBI impose strict penalties when such harassment is reported?

I was into similar situation with Kotak Bank. Despite writing to Nodal officer they have not stopped calling me. I have raised request to RBI and after 2 months they marked credit card overdue as closed and stop chasing me.
